- Communications: emails, text messages (SMS), and form submissions you send us
3. How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve our tutoring and course services

- Send service-related communications (confirmations, reminders, updates) via email and SMS

- Power AI-assisted features such as automated ACT grading and feedback

4. How We Share Your Information
We do not sell your personal information. We may share your information with:
- Service providers that help us operate our Services, including:

- Scheduling: Calendly

- Tutors: your student’s assigned tutor will have access to relevant student information (name, grade, scores, session notes) to provide effective tutoring

Each of these service providers is bound by their own privacy and data protection obligations. We do not authorize them to use your personal information for their own purposes beyond what is necessary to provide services to us.
5. AI Processing
Some features of our Services use artificial intelligence provided by third-party vendors (currently OpenAI) to process student work, generate grading feedback, and support instructional recommendations. When student work is submitted through these features:
- The content is transmitted to our AI service provider for processing.
- We do not use student-submitted content to train AI models.
- AI-generated outputs are used to support, not replace, human instruction.

6. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including encrypted data transmission (HTTPS), access controls, and secure hosting infrastructure. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
In the event of a data breach that affects your personal information, we will notify you in accordance with applicable law, including the Alabama Data Breach Notification Act, which requires notification within 45 days of discovery of a breach.
7. Data Retention
We retain your personal information for as long as necessary to provide our Services and comply with legal obligations. Generally:
- Active account data is retained while your account is active.
- Student records (scores, session history, notes) are retained for 3 years after the last active enrollment.
- Payment and transaction records are retained for 7 years for tax and accounting purposes.
You may request deletion of your personal information at any time (see Section 8). Deletion requests will be honored except where retention is required by law.
8. Your Rights
Regardless of your location, you have the right to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Delete your personal information (subject to legal retention requirements)
- Opt out of marketing emails and SMS at any time
- Receive a copy of your data in a portable format

Our Services are designed for use by parents and guardians enrolling students aged 14–18. We do not knowingly collect personal information directly from children under 13 without verified parental consent. Where we collect information about students under 13, we do so only through the parent or guardian who enrolls the student and consents on their behalf.
If you believe we have collected personal information directly from a child under 13 without parental consent, please contact us immediately at support@ngeniusprep.com and we will promptly investigate and delete such information.

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Last updated” date. We encourage you to review this policy periodically. Continued use of our Services after changes constitutes acceptance of the revised policy.
