1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the websites, services, courses, tutoring programs, and related offerings (collectively, the “Services”) provided by Four Stones Digital LLC, doing business as nGenius Prep and nGenius Academy(“Company,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Services Overview

nGenius Prep and nGenius Academy offer the following:

  • ACT Blueprint — Our flagship program: 6 one-on-one tutoring sessions (85 min each), 4 weekend group sessions, 2 full-length proctored mock ACTs, weekly coaching calls, a personalized study plan, ScoreJump course access, and a 2-point score improvement guarantee. $1,597 (payment plans available).
  • ACT Intensive — 8 one-on-one tutoring sessions (85 min each) covering all four ACT sections with flexible scheduling. $1,097.
  • ACT Edge — 4 one-on-one tutoring sessions (85 min each) targeting 1–2 specific ACT sections. $647.
  • ScoreJump ACT Course — Self-paced online ACT prep course. $147.

Prices, program structures, and availability are subject to change. Current pricing is displayed on the relevant program pages at the time of enrollment.

3. Account Security, Eligibility & Minors

You must provide accurate and complete information when creating an account or enrolling in a program. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Our Services are intended for students typically aged 14–18. If you are under 18, you may use our Services only with the involvement and consent of a parent or legal guardian. By enrolling a minor student, the parent or legal guardian: (a) represents they are the parent or legal guardian of that student; (b) consents on behalf of the student to these Terms and our Privacy Policy, including the collection and use of the student’s personal information as described therein; and (c) accepts responsibility for the student’s use of the Services. We do not knowingly allow children under 13 to create accounts or use our Services without verified parental consent.

4. Tutoring Sessions

  • Sessions are 85 minutes in length.
  • Sessions are available in person at our Madison, AL location or via Zoom.
  • Cancellation & rescheduling:Sessions may be rescheduled with at least 24 hours’ notice at no charge. Sessions canceled or missed with less than 24 hours’ notice are forfeited — no credit or refund will be issued.
  • Scheduling: We will make reasonable efforts to accommodate your preferred schedule, but specific days and times are not guaranteed. ACT Blueprint cohorts run on a fixed schedule tied to ACT test dates.

5. Score Improvement Guarantee

The ACT Blueprint program includes a 2-point composite score improvement guarantee, subject to the following conditions:

  1. Eligibility:The student’s starting ACT composite score must be 28 or below. The starting score is established by the student’s most recent official ACT score or the pre-program mock ACT administered by nGenius Prep.
  2. Completion requirements: The student must complete every scheduled one-on-one session, attend all assigned group sessions, complete all assigned practice work, and take the post-program mock test.
  3. Official score: The guarantee applies to one (1) official ACT attempt taken after program completion. Official ACT score reports (pre and post) are required.
  4. Remedy:If the student meets all requirements above and their official ACT composite score does not increase by at least 2 points, we will refund the full program cost. No partial refunds, credits, or course retakes — a full refund.
  5. Exclusions: The score guarantee applies only to the ACT Blueprint program. The ACT Intensive, ACT Edge, and ScoreJump course do not include a score guarantee.

6. Digital Products & Course Access

When you purchase a digital course (including ScoreJump), you receive a limited, non-exclusive, non-transferable, revocable license to access the course content for personal, non-commercial use.

  • You may not share your login credentials with any third party.
  • You may not copy, record, distribute, resell, or publicly display any course content.
  • Course access is granted for 12 months from the date of purchase unless otherwise stated.
  • We reserve the right to revoke access for violations of these Terms.

7. Payment & Refunds

All payments are processed through our authorized payment processor (currently ThriveCart/Stripe). Payment plan installments are due on the dates specified at checkout. Failure to complete payment plan installments may result in suspension of services.

72-Hour Full Refund: You may request a full refund within 72 hours of purchase, provided no tutoring sessions have been completed and no digital course access has been activated. To request a refund under this policy, contact us at support@ngeniusprep.com within the 72-hour window. Approved refunds will be processed within 10 business days.

After the 72-hour window, or once the first session has been completed or course access has been activated, purchases are non-refundable except as provided by the Score Improvement Guarantee (Section 5) or at the sole discretion of the Company.

8. AI-Assisted Features

Certain features of our Services use artificial intelligence, including third-party AI services (such as OpenAI), to provide automated grading, practice feedback, and study recommendations. When you or your student submits work through these features (such as the ACT Grader), the content may be transmitted to our AI service providers for processing.

  • We do not use student-submitted content to train AI models.
  • AI-generated feedback is supplemental and does not replace instructor review where applicable.
  • By using AI-assisted features, you consent to this processing on behalf of yourself and, if applicable, your enrolled student.

If you prefer that your student’s work not be processed by AI tools, please contact us at support@ngeniusprep.com to discuss alternatives.

9. SMS & Text Message Communications

By providing your phone number and enrolling in our Services, you consent to receive text messages from nGenius Prep at the number provided, including:

  • Service messages: scheduling confirmations, session reminders, account updates, and program-related notifications.
  • Marketing messages: promotional offers, program announcements, and other marketing content (only if you have opted in).

Message frequency varies. Message and data rates may apply. You may opt out of marketing text messages at any time by replying STOP to any marketing message or contacting us at support@ngeniusprep.com. Opting out of marketing texts does not affect service messages required to deliver your enrolled program. For help, reply HELP or contact support.

10. Image Consent & Recordings

Zoom sessions may be recorded for quality assurance and tutor training purposes. You will be notified at the start of any recorded session.

We will not use photographs, video recordings, or testimonials of you or your minor student for external marketing or promotional purposes without your prior written consent. If you wish to provide a testimonial or allow use of your student’s likeness in our marketing materials, we will request a separate written authorization.

11. Intellectual Property

All content, materials, curricula, methodologies, course content, and branding associated with nGenius Prep and nGenius Academy are the intellectual property of Four Stones Digital LLC. Unauthorized reproduction, distribution, or use is prohibited.

12. Prohibited Uses

You agree not to:

  • Use our Services for any unlawful purpose.
  • Share, distribute, or resell any course materials or proprietary content.
  • Impersonate another person or misrepresent your affiliation.
  • Attempt to gain unauthorized access to our systems or other users’ accounts.
  • Use automated systems (bots, scrapers) to access our Services.

13. Disclaimer of Warranties

Our Services are provided “as is” and “as available.” Except for the express Score Improvement Guarantee described in Section 5, we make no warranties, express or implied, regarding the results you or your student will achieve. ACT scores depend on many factors including student effort, test-day conditions, and individual aptitude.

14. Limitation of Liability

To the fullest extent permitted by law, Four Stones Digital LLC and its officers, employees, tutors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount you paid for the specific Service giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Four Stones Digital LLC, its officers, employees, tutors, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of our Services or violation of these Terms.

16. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall first be submitted to informal resolution by contacting us at support@ngeniusprep.com. If informal resolution is not achieved within 30 days, the dispute shall be resolved by binding arbitration administered in Madison County, Alabama, in accordance with the rules of the American Arbitration Association, except that either party may bring an individual claim in small claims court in Madison County, Alabama if the claim qualifies. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. For claims under $10,000, we will pay all AAA filing and arbitration fees.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict-of-law provisions.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated “Last updated” date. We encourage you to review these Terms periodically. Continued use of our Services after changes constitutes acceptance of the revised Terms.
